			<content:encoded><![CDATA[<p>The state of Arizona has some of the toughest DWI / DUI laws in the United States. For an individual who may be charged with this offense, the penalties, fees, and court costs may pale in comparison to the potential jail time that may be incurred with a DWI/DUI offense.</p>
<p>Arizona has implemented DWI / DUI laws based on what is known as a tier system. Through this system, the number of offenses committed by an individual will be the baseline for potential penalities and punishments. The tier system is designed around the severity of the DWI / DUI offense:</p>
<p>Tier 1: Class One Misdemeanor: Minimum sentencing can be anywhere from one to ten days in jail, alcohol counseling, and $750 in court costs and fines. An individual can expect a suspension of drivers license for up to 90 days. A maximum DWI/DUI sentence can lead to a possible six month jail sentence, alcohol screening and counseling, as well as court costs in the amount of $3000. Drivers license suspension for 90 days is mandatory in the state of Arizona.</p>
<p>Tier 2: Class One Misdemeanor: Extreme DUI penalties can lead to an offender serving a minimum sentence of ten to thirty days in jail, alcohol screening and counseling, as well as court cost and fines in the amount of $1500. Maximum sentencing for an extreme DUI offense is six months in jail, $3750 in court costs and fines, along with alcohol screening and counseling. All extreme DWI/DUI offenses carry a mandatory 90 day to one year suspension of driving priviledges.</p>
<p>Tier 3: Class One Misdemeanor: Second Conviction Offense. Depending upon whether this conviction occurred within seven years of the original offense, the following penalties may be incurred. A minimun of 30 to 90 days in jail, alcohol screening and counseling, $1750 in court cost and fines, along with a one year revocation of driving priviledges. The maximum sentencing for this offense is six months in jail, $3750 in court costs and fines, alcohol screening and counseling, as well as a one year revocation of driving priviledges. Within this class of offenses, the offender may also be subject to an ignition interlock device which allows the court to set up a device that will in effect, administer a breathalyzer that is attached to the offenders automobile. If alcohol is detected, the ignition will be automatically locked.</p>
<p>Tier 4: Class One Misdemeanor: Second Conviction Extreme DUI Penalties: The minimum sentence for this level of offense is 60 to 120 days in jail, alcohol screening and counseling, court costs and fines in the amount of $2000, and a one year drivers license revocation. Maximum sentencing for this offense is six months in jail, alcohol screening and counseling, $4500 in court costs and fines, along with a one year drivers license revocation. Again, the use of an ignition interlock device is mandatory for repeat offenses of this level.</p>
<p>The severity of committing a DWI/DUI offense in Arizona is quite high, yet clearly within the bounds of state law.</p>

It is clearly stipulated under Minnesota laws that driving while under the influence of alcohol, drugs, or combinations of hazardous controlled substances is a crime. Refusing drug testing is also a crime. Punishments can include loss of driver’s license, retribution for damages, fines or jail time up to seven years. Repeat offenders are subject to mandatory minimum sentences dictated by the offense.</p>
<p>The Minnesota Statutes codify these DWI laws in Chapter 169A. The laws define what is considered to be prohibited behavior. It lists the criminal penalties that may apply, pretrial procedures for mandatory hold and conditional release, and mandatory minimum sentences that may apply.</p>
<p>Chemical testing is important for conviction under Minnesota implied consent law. Refusal to take some type of drug test offered is a crime. The law sets forth procedures that police officers must follow to detect and charge a driver with a DWI crime. There are guidelines for chemical dependency assessment and treatment, and rehabilitation procedures. The blood alcohol limit for drivers in the state of Minnesota is .08.</p>
<p>If someone is killed or injured in a vehicular accident that occurs while one or more drivers are DWI, it is chargeable as CVO, criminal vehicular operation. If a DWI conviction results in a jail term of more than one year, it is a felony DWI. Criminal penalties are tiered and increase with every conviction.</p>
<p>The statues lay out laws for limited driver’s licenses, restricted driver’s licenses and reinstatement of driver’s licenses as they relate to DWI convictions. Persons may be able to obtain a work permit license even after loss of license due to DWI. Once a driver’s license is restricted with a “no alcohol” restriction, the restriction is permanent.</p>
<p>Under Minnesota DWI laws, a person’s driver’s license may be temporarily revoked. Driver license reinstatement fees following conviction of DWI are memorable. It will cost the driver in an alcohol-related or CVO situation $250 for license reinstatement and an additional $450 surcharge, plus a $24 fee.</p>

Aircraft pilots have the same lower level and are prohibited from flying within 8 hours of consuming alcohol. Students and youth have a zero tolerance limit in Minnesota. Drivers aged 16 and 17 will be prosecuted as adults.</p>
<p>Under administrative sanctions for DWI in Minnesota, the driver may lose their license for periods of from 90 days to one year, or the license may be permanently revoked as a public safety policy. DWI drivers who have multiple occurrences must undergo treatment and rehabilitation before a license might be reissued.</p>
